Bizby Terms of Service

1. Acceptance of Terms

By accessing or using Bizby, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our service.

2. Account Registration

To use certain features of Bizby, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

3. Use of Service

You agree to use Bizby only for lawful purposes and in accordance with these Terms. You agree not to:

  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the service or servers
  • Upload or transmit viruses, malware, or other malicious code
  • Use the service to harass, abuse, or harm others

4. Subscription and Payments

Certain features of Bizby require a paid subscription. By subscribing, you agree to:

  • Pay all fees associated with your chosen subscription plan
  • Provide accurate payment information
  • Authorize us to charge your payment method on a recurring basis

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are provided in accordance with our refund policy.

5. User Content

You retain ownership of all content you create, upload, or share through Bizby ("User Content"). By using our service, you grant Bizby a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely as necessary to provide and improve the service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not infringe on the rights of others
  • Your User Content complies with these Terms and applicable laws

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

6. Cookies and Tracking

Bizby uses cookies and similar tracking technologies to provide and improve our service. By using Bizby, you consent to our use of necessary cookies. 7. Intellectual Property

Bizby and its original content, features, and functionality are owned by Bizby and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on Bizby without our express written permission.

8. Third-Party Services

Bizby may contain links to third-party websites or services that are not owned or controlled by Bizby. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

9. Termination

We may suspend or terminate your access to Bizby at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Any other reason at our sole discretion

Upon termination, your right to use Bizby will immediately cease. We may delete your account and User Content, though we may retain certain information as required by law or for legitimate business purposes.

10. Disclaimer of Warranties

Bizby is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy, reliability, or completeness of content

We do not guarantee that the service will meet your requirements or that any defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by law, Bizby and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or use
  • Business interruption
  • Damages arising from your use or inability to use the service

Our total liability for any claims related to Bizby shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Bizby and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Bizby shall be subject to the exclusive jurisdiction of the courts located in Canada.

14. Changes to Terms

We may update these Terms from time to time. The "Effective Date" at the top indicates when the terms were last revised. We will notify you of material changes by posting the new Terms on this page and, where appropriate, providing additional notice. Continued use of Bizby after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bizby regarding the use of our service and supersede any prior agreements.
